The terms of this agreement (”Terms of Use”) govern the relationship between you (“you” or “user”) and SHIO (”SHIO”, ”we”, ”us”, or ”our”) regarding your access to and use of our location tracking service, including any associated mobile applications, websites, and related features (collectively, the ”Service”). By accessing or using the service, you agree to be bound by these Terms. If you do not agree to these Terms, you must discontinue all use of the Service immediately.
1. Acceptance of Terms
By downloading, accessing, or using the Service, you acknowledge that you have read, understood, and agreed to these Terms of Use and our Privacy Policy. If you do not agree, you must stop using the service immediately.
2. Eligibility
To use the Service, you must be at least 16 years old or have the consent of a parent or legal guardian. By using our service, you confirm that you meet this requirement.
3. Account Registration and Security
When creating an account, you agree to the following:
- You must provide accurate and complete registration details.
- You are responsible for maintaining the confidentiality of your account credentials.
- You agree to notify us immediately of any unauthorized access to your account.
4. Acceptable Use Policy
You agree to use the Service only for lawful purposes and in accordance with these Terms. You may not:
- Use the Service for any illegal, harmful, or fraudulent activities.
- Use the Service to track individuals without their explicit consent.
- Provide false information or impersonate another person.
- Interfere with or disrupt the Service’s functionality.
5. Subscription and Payment Terms
SHIO offers subscription-based services. By purchasing a subscription:
- You authorize us to charge your selected payment method.
- Subscriptions renew automatically unless canceled before the next billing cycle.
- You can cancel your subscription at any time through your app store account settings. If canceled, you will retain access until the end of the current billing cycle.
- Users are responsible for confirming and understanding all charges before completing a transaction. SHIO does not assume liability for any additional charges imposed by third-party payment providers, such as exchange fees or other foreign transaction fees
Refunds: All payments and refunds are handled by Apple via the App Store. If technical issues prevent or unreasonably delay the delivery of the Service, your sole and exclusive remedy is a replacement or refund, as determined by Apple. You may request a refund or report a problem through https://reportaproblem.apple.com. Apple may decline refund requests if there is evidence of fraud, abuse of the refund system, or other manipulative behavior. For more information, please visit https://support.apple.com.
6. Privacy and Data Protection
Your privacy is important to us. We process personal data in compliance with GDPR (EU/EEA regulations). Please refer to our Privacy Policy for details on how we collect, use, and store your data.
7. Location Data Usage
- The Service requires access to your location data to provide tracking services.
- You must ensure that you have obtained consent from any individual you track.
- We do not share location data with third parties except as required by law or outlined in our Privacy Policy.
- By using the Service, you acknowledge that continuous location access may affect device battery life.
8. Termination of Service
We reserve the right to suspend or terminate your account if you:
- Violate these Terms of Use.
- Engage in fraudulent or unauthorized activities.
- Pose a security risk to SHIO or its users. You may also cancel your account at any time by following the instructions within the app.
9. Disclaimer of Warranties
The Service is provided ”as is” and ”as available”, without warranties of any kind. We do not guarantee:
- Continuous, uninterrupted, or error-free service.
- Accuracy or completeness of tracking data.
- That the Service will be free from viruses or other harmful components.
10. Third-Party Services
The Service integrates with third-party services. We are not responsible for their terms, privacy policies, or service disruptions.
11. Intellectual Property Rights
All content, software, text, images, logos, and other materials within the Service are the property of SHIO or its licensors and are protected by intellectual property laws. You may not reproduce, distribute, modify, or publicly display any part of the service without prior written consent from SHIO.
12. License Grant
SHIO grants you a limited, non-exclusive, non-transferable, and revocable license to access and use the Service for personal, non-commercial purposes, subject to these Terms of Use. This license does not permit any resale or commercial use of the service or its content.
13. Modifications to the Service
SHIO reserves the right to modify, update, suspend, or discontinue the Service (or any part thereof) at any time, temporarily or permanently, with or without prior notice. SHIO shall not be liable to you or any third party for any modification, suspension, or discontinuation of the Service. You acknowledge that continued use of the Service following any changes constitutes your acceptance of those changes.
14. Indemnification
You agree to indemnify, defend, and hold harmless SHIO, its owners, affiliates, officers, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including legal fees) arising out of or in any way connected with:
- your access to or use of the Service,
- your violation of these Terms, or
- your infringement of any third-party rights.
15. Changes to Terms
We may update these Terms of Use periodically. If we make significant changes, we will notify users via email or in-app notifications. Your continued use of the Service following the update constitutes your acceptance of the new Terms.
16. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, THE SERVICE AND IT’S OWNER (SHIO) SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, OR CONSEQUENTIAL DAMAGES ARISING FROM THE USE OF OR INABILITY TO USE THE SERVICE. THIS INCLUDES, BUT IS NOT LIMITED TO:
- LOSS OF DATA, REVENUE, OR BUSINESS OPPORTUNITIES.
- UNAUTHORIZED ACCESS, SECURITY BREACHES, OR DATA LOSS BEYOND OUR CONTROL.
- ERRORS, INTERRUPTIONS, OR INACCURACIES IN THE SERVICE.
- PERSONAL INJURY, DEATH, OR PROPERTY DAMAGE RESULTING FROM YOUR USE OF THE SERVICE.
- THIRD-PARTY SERVICES, BUGS, OR SYSTEM FAILURES.
THE SERVICE COMPLIES WITH GDPR AND APPLICABLE DATA PROTECTION LAWS. HOWEVER, WE CANNOT GUARANTEE COMPLETE SECURITY AGAINST UNAUTHORIZED ACCESS OR MALICIOUS ATTACKS.
THIS LIMITATION OF LIABILITY APPLIES TO THE FULLEST EXTENT PERMITTED BY LAW.
SHIO IS OPERATED FROM SWEDEN AND COMPLIES WITH GDPR. USERS OUTSIDE THE EU ARE RESPONSIBLE FOR ENSURING THEIR USE OF THE SERVICE COMPLIES WITH LOCAL LAWS.
17. Emergency Use Disclaimer
SHIO IS NOT AN EMERGENCY RESPONSE SERVICE AND IS NOT INTENDED TO REPLACE PROFESSIONAL EMERGENCY SERVICES (e.g., POLICE, AMBULANCE). The service is designed to help you stay connected with your family and friends by sharing your location. In case of an emergency, you should immediately contact your local emergency services using the appropriate emergency number for your country. SHIO does not guarantee immediate assistance or response in emergency situations.
18. Governing Law and Dispute Resolution
These Terms are governed by Swedish law. Any disputes shall be resolved in Swedish courts.
